Following the Directive 2008/52/EC, Mediation in civil and commercial matters in Greece, is regulated under the Greek Law 4640/2019.
Mediation is an alternative dispute resolution mechanism promoting the amicable settlement of disputes and/or complex legal cases. It enables the parties to reach a mutually accepted solution through a structured process with the assistance of a third impartial and neutral party – the Mediator. The Mediator is not a judge, nor do they issue a ruling; instead they monitor the process, facilitate dialogue and communications, and help the parties seek a mutually accepted position.
Mediation as opposed to standard litigation process is cost and time-effective procedure, taking into account the timelines and delays of the current system of administration of justice in Greece. Most importantly though, it leads to a successful dispute resolution, with an overall 75% rate of success, as the solution is adapted to the parties interests and needs.
